Welcome to VideoReject. These Terms of Service ("Terms") govern your access to and use of the VideoReject website, mobile applications, and services (collectively, the "Service"). Please read these Terms carefully before using our Service.

1. Acceptance of Terms

By accessing or using VideoReject, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service. We may modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service following any modifications indicates your acceptance of the modified Terms.

2. Description of Service

VideoReject is an online marketplace that enables users to buy and sell physical media including, but not limited to, VHS tapes, DVDs, Blu-ray discs, 4K UHD discs, LaserDiscs, and Betamax tapes. VideoReject provides the platform and technology to facilitate these transactions but is not a party to any transaction between buyers and sellers.

3. Eligibility

To use VideoReject, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Be able to form legally binding contracts
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information
• Maintain the security of your account credentials

4. Account Registration and Security

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

5. Buyer Terms

5.1 Purchasing Items

When you purchase an item on VideoReject, you are entering into a binding contract with the seller. By completing a purchase, you agree to pay the listed price plus any applicable shipping costs and taxes.

5.2 Payment

All payments are processed through our secure payment processor, Stripe. By making a purchase, you authorize us to charge your payment method for the total amount. You represent that you are authorized to use the payment method provided.

5.3 Buyer Protection

VideoReject offers buyer protection for eligible purchases. If an item is not received, is significantly not as described, or is damaged during shipping, you may be eligible for a refund. To qualify for buyer protection:

• Payment must be made through VideoReject's checkout system
• You must report the issue within 7 days of delivery (or expected delivery date)
• You must provide documentation as requested (photos, tracking info, etc.)
• You must attempt to resolve the issue with the seller first

5.4 Returns and Refunds

Return policies are set by individual sellers. Before purchasing, review the seller's return policy. If a seller accepts returns, you are responsible for return shipping costs unless the item was not as described or was damaged.

6. Seller Terms

6.1 Becoming a Seller

To sell on VideoReject, you must complete our seller onboarding process, which includes identity verification and connecting a valid bank account for payouts through Stripe Connect.

6.2 Listing Requirements

When creating listings, you must:

• Provide accurate and complete descriptions of items
• Use your own photos that accurately represent the item's condition
• Disclose all known defects, damage, or issues
• Set fair and accurate pricing
• Only list items you legally own and have the right to sell
• Comply with all applicable laws regarding the sale of media

6.3 Prohibited Items

The following items are strictly prohibited on VideoReject. Listings that violate these rules will be removed immediately and may result in permanent account suspension without warning.

Prohibited Content Categories

• Pornographic or sexually explicit material — This includes, but is not limited to, adult films, X-rated or unrated pornographic content, and any media whose primary purpose is the depiction of sexual acts. This applies to all formats (VHS, DVD, Blu-ray, etc.).
• Child Sexual Abuse Material (CSAM) — Any media depicting, promoting, or related to the sexual exploitation of minors is absolutely prohibited and will be reported to law enforcement, including the National Center for Missing & Exploited Children (NCMEC).
• Content depicting real violence, torture, or death — This includes "snuff" films, crush videos, or media depicting actual acts of violence against persons or animals. Fictional horror, action, and genre films with simulated violence are permitted.
• Hate speech and extremist material — Media created primarily to promote hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin. Historical or documentary material that addresses these topics in an educational context may be permitted at our sole discretion.
• Propaganda or recruitment material for terrorist organizations

Prohibited Item Types

• Counterfeit, bootleg, or pirated media — Unauthorized copies, reproductions, or "factory sealed" rewraps of commercially released media
• Stolen property — Including items from rental stores that were not legitimately acquired for resale
• Items that infringe on intellectual property rights — Unauthorized recordings, unlicensed compilations, or fan-made reproductions sold as official releases
• Digital downloads, codes, or non-physical items — VideoReject is a marketplace for physical media only
• Items prohibited by law — Items illegal to sell in the seller's or buyer's jurisdiction
• Items misrepresented as to condition, authenticity, or origin — Including undisclosed ex-rental copies, reprints sold as originals, or items with doctored photos
• Recalled or banned media — Items subject to government seizure or court-ordered destruction (where applicable by jurisdiction)
• Non-media items — VideoReject is not a general marketplace. Listings must be for physical media or directly related accessories (e.g., VCR head cleaners, media storage cases)

Listing Content Standards

In addition to the item itself, all listing content — including titles, descriptions, and photographs — must comply with these terms. Listings may not contain:

• Sexually explicit images, even as cover art photos (listings for R-rated films with suggestive cover art are permitted provided the images are not cropped or edited to emphasize explicit content)
• Graphic depictions of real violence or gore in listing photos
• Slurs, hate speech, or discriminatory language in listing descriptions
• Links to external sites, off-platform sales channels, or competing marketplaces

Enforcement

VideoReject reserves the right to remove any listing and suspend or permanently ban any user who violates these policies, at our sole discretion and without prior notice. Determinations about whether content violates these terms are made by VideoReject and are final. Repeated or egregious violations will result in permanent account termination and forfeiture of any pending payouts. We may also report illegal content to the appropriate law enforcement authorities.

6.4 Shipping Obligations

Sellers must:

• Ship items within the stated processing time (default: 3 business days)
• Use appropriate packaging to protect items during transit
• Provide valid tracking information for all shipments
• Ship to the address provided by VideoReject (no off-platform shipping)
• Accurately represent shipping costs and delivery timeframes

6.5 Fees and Payments

VideoReject charges the following fees:

• Transaction Fee: 5.0% of the item sale price (excluding shipping)
• Payment Processing Fee: 2.9% + $0.30 per transaction (Stripe fees)

Fees are deducted from your sale proceeds before payout. Payouts are processed according to your selected payout schedule (daily, weekly, or monthly) to your connected bank account.

6.6 Taxes

Sellers are responsible for determining and paying all applicable taxes on their sales. VideoReject may collect and remit sales tax in certain jurisdictions as required by law. You are responsible for reporting income from sales on VideoReject to appropriate tax authorities.

7. Offers and Negotiations

Sellers may enable the "Make an Offer" feature on their listings. When enabled:

• Buyers may submit offers at or above the seller's minimum offer amount
• Sellers have 48 hours to accept, decline, or counter an offer
• Accepted offers create a binding obligation to complete the transaction
• Offers expire if not responded to within the time limit

8. User Conduct

VideoReject is committed to maintaining a safe, respectful, and lawful community. You agree not to:

• Violate any applicable laws or regulations
• List, sell, or distribute prohibited items or content as defined in Section 6.3
• Infringe on the intellectual property rights of others
• Post false, misleading, or deceptive content
• Upload pornographic, sexually explicit, or obscene material anywhere on the platform, including profile images, listing photos, messages, or reviews
• Harass, threaten, intimidate, or send unsolicited sexual content to other users
• Use the messaging system to solicit off-platform transactions, promote other services, or engage in spam
• Manipulate prices, feedback, or search results
• Circumvent fees by conducting transactions off-platform
• Create multiple accounts for deceptive purposes or to evade enforcement actions
• Use automated tools, bots, or scrapers to access the Service without permission
• Interfere with the proper functioning of the Service
• Attempt to gain unauthorized access to any part of the Service
• Impersonate another person, user, or entity

Violations of these conduct standards may result in content removal, account suspension, permanent bans, forfeiture of pending payouts, and/or referral to law enforcement where appropriate.

9. Reviews and Feedback

After completing a transaction, buyers may leave reviews for sellers. Reviews must be:

• Based on actual transaction experiences
• Honest and accurate
• Free of profanity, threats, or personal attacks
• Not used to extort or manipulate other users

VideoReject reserves the right to remove reviews that violate these guidelines.

10. Intellectual Property

The VideoReject name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of VideoReject. You may not use such marks without our prior written permission. All content you submit to VideoReject (listings, photos, reviews) remains your property, but you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with the Service.

11. Dispute Resolution

If a dispute arises between a buyer and seller, we encourage you to first attempt to resolve the issue directly. If you cannot reach a resolution:

• Contact VideoReject support within 7 days of the issue arising
• Provide all relevant documentation and communication
• Cooperate with our investigation and resolution process

VideoReject's decision on disputes is final. We reserve the right to hold funds, issue refunds, or take other actions as we deem appropriate to resolve disputes fairly.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDEOREJECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

VideoReject is a platform that facilitates transactions between buyers and sellers. We are not responsible for:

• The quality, safety, or legality of items listed
• The accuracy of listings or user content
• The ability of sellers to sell items or buyers to pay for them
• User conduct on or off the platform

13. Indemnification

You agree to indemnify, defend, and hold harmless VideoReject and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

14. Termination

VideoReject reserves the absolute right to suspend, restrict, or permanently terminate any user account at any time, for any reason or for no reason, at our sole and unfettered discretion, with or without prior notice. Reasons for termination may include, but are not limited to, violations of these Terms, suspected fraudulent or illegal activity, complaints from other users, inactivity, or any conduct that we determine, in our sole judgment, to be harmful to the platform, its users, or the VideoReject brand.

You acknowledge and agree that VideoReject is not required to provide a reason for any account suspension or termination and that our decision is final and not subject to appeal or review. Upon termination:

• Your right to access and use the Service immediately and permanently ceases
• You remain liable for all obligations incurred prior to termination, including any pending sales, shipping obligations, and dispute resolutions
• Pending transactions must be completed or properly cancelled at VideoReject's discretion
• Any funds legitimately owed to you will be paid out according to our standard payout schedule, less any amounts owed to VideoReject or held for pending disputes or chargebacks
• VideoReject may withhold or delay payouts if we reasonably suspect fraud, policy violations, or potential chargebacks
• In cases of serious violations (including but not limited to prohibited content, fraud, or illegal activity), all pending payouts may be forfeited
• You may not create a new account after termination without our express written permission

Sections of these Terms that by their nature should survive termination — including but not limited to Prohibited Items (6.3), Limitation of Liability (12), Indemnification (13), and Governing Law (15) — shall survive any termination of your account or these Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
